The eDiscovery and Data Extraction Process

1. Identification

Identification, the first step is to identify the sources of electronic data that may be relevant to the case. This can include emails, images, documents, databases social media posts, metadata and many other types of electronic files.

2. Preservation

Preservation, once the sources of electronic data has been identified it is important to preserve the data to ensure its integrity and prevent any loss or alteration. This may involve issuing legal holds and implementing measures to prevent the deletion or modification of relevant data collection. A data chain of custody is a process that documents the handling of data to ensure its integrity and security.

3. Collection

Collecting the electronic data from the identified sources can be done through various methods such as forensic Imaging data extraction or targeted collection. It is important to use appropriate and defensible collection methods to ensure the admissibility of the collected data in a court of law.

4. Processing

Processing the collected data is a vital element to the entire process, it is important to ensure the data is searchable and usable for review. This requires converting the data into a standardized format extracting metadata and applying filters to remove duplicates and irrelevant files and other data.

5. Review

Once the data has been processed it is then reviewed by legal professionals to determine its relevance to the case. This can involve keyword searches and manual review of individual documents and email messages. Various tools and software are used to facilitate the review process and to increase the efficiency analysis during the review process.

6. Analysis

The legal team may also perform analysis on the collected data to identify patterns, relationships and key evidence. This can involve data visualization clustering and statistical analysis production after the review and analysis is completed.

7. Production

The relevant electronic data is produced and shared with the opposing party or parties as required by the legal process. This at times may involve redacting sensitive information and producing the data in a specified format or the use of eDiscovery platforms e.g, SC-DISCO, Nuix and Relativity.

8. Presentation

Finally the collected and reviewed electronic data may be presented in court as evidence to support the arguments of the parties involved in the case. This can involve presenting the data in a visual format such as charts graphs or multimedia presentations. It is important to note that the specific steps and processes involved in collecting and reviewing electronic discovery may vary depending on the nature of the case the jurisdiction and the specific tools and technologies used.
